Affiliate Terms & Conditions (India-Specific Version)

- Introduction
Welcome to the Madhur Sparsh Affiliate Program (“Program”). By signing up as an affiliate, you agree to abide by these Terms & Conditions (“Agreement”). Please read them carefully before joining.
This Agreement is a legally binding contract between you (“Affiliate”, “you”) and Madhur Sparsh (“Company”, “we”, “our”, “us”).
- Eligibility
You must be 18 years or older to participate.
You must be a resident of India or any other country permitted under applicable Indian laws.
You must have an active bank account or UPI ID in India for receiving payouts.
Affiliates must not use spam, misleading advertising, or illegal marketing methods.
- Registration & Approval
Registration does not guarantee acceptance into the Program.
We reserve the right to approve or reject any application at our discretion without providing a reason.
- Affiliate Links & Promotion
You will receive a unique affiliate link after approval.
You may promote this link via blogs, websites, social media, and other permitted channels.
Prohibited Activities:
- Using the brand name "Madhur Sparsh" in paid ads without prior written approval.
- Posting false, misleading, or offensive content about the brand.
- Using cookie stuffing, bots, or any fraudulent methods.
- Commission Structure
You will earn ₹100 per link (flat) for each qualifying purchase made through your affiliate link.
The commission rate may change with prior notice.
- Payment Terms
Payments will be processed monthly.
Payouts will be made only when your earnings exceed ₹200.
If you do not meet the threshold, your earnings will roll over to the next month.
Payments will be made via bank transfer or UPI only.
Tax Compliance: You may be required to submit your PAN and GST details as per Indian tax laws. TDS will be deducted where applicable.
- Refunds & Chargebacks
If a customer’s order is cancelled, refunded, or results in a chargeback, the related commission will be deducted from your future payouts.
- Compliance with Laws
You must comply with:
The Information Technology Act, 2000
The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
Applicable Indian advertising, e-commerce, and tax laws
- Termination
We may terminate your affiliate account at any time for violation of these Terms or for fraudulent activity.
Upon termination, you will lose access to your affiliate dashboard, and unpaid commissions may be forfeited if earned through prohibited activities.
- Limitation of Liability
We are not liable for indirect, incidental, or special damages arising from your participation in the Program.
Our total liability shall not exceed the total commission paid to you in the 3 months preceding the claim.
- Dispute Resolution & Governing Law
Any disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996 (India).
The arbitration will take place in Kasganj, Uttar Pradesh, India, in English.
This Agreement shall be governed by the laws of India.
- Changes to the Agreement
We may update these Terms & Conditions at any time.
Continued participation in the Program after changes constitutes your acceptance of the updated terms.
